Fifth Meeting of the Working Group on Jurisdiction

From 18 to 22 September 2023, the Working Group on Matters Related to Jurisdiction in Transnational Civil or Commercial Litigation met for the fifth time. The meeting was held in Buenos Aires (Argentina) in hybrid format, in accordance with the Council on General Affairs and Council’s decision that the fifth Working Group meeting could be held in a location outside the Netherlands (C&D No 9). The meeting was attended by 64 experts in total, of which 35 attended in person. The experts represented 21 Members and two Observers. The meeting was organised by the Permanent Bureau of the HCCH, including its Regional Office for Latin America and the Caribbean, with the generous support of the Ministry of Foreign Affairs of Argentina and the Organización de Estados Iberoamericanos para la Educación, la Ciencia y la Cultura.

Pursuant to its mandate, the Working Group made further progress on the development of draft provisions on parallel proceedings and related actions or claims, which may occur when separate proceedings are instituted before the courts of different States. The sixth meeting of the Working Group will take place in January 2024. The Working Group will present a report on the progress of its work to the Council on General Affairs and Policy in March 2024, including the provisions derived from its discussions.
