Paraguayan draft legislation implementing Draft Hague Principles on Choice of Law in International Contracts

On 7 May 2013, Senator Hugo Esteban Estigarribia Gutiérrez presented to Don Alfredo Luis Jaeggli, President of the Chamber of Senators of the Paraguayan Congress (Congreso de la República de Paraguay), draft legislation to implement the Draft Hague Principles on Choice of Law in International Contracts.

Pursuant to article 203 of the Constitution of Paraguay of 1992, the draft legislation seeks to reform the current regime in Paraguay governing choice of law in international contracts.
Professor José Antonio Moreno Rodríguez initially developed the draft legislation based on the Draft Hague Principles on Choice of Law in International Contracts. The draft was then subject to further revision by Senator Hugo Esteban Estigarribia Gutiérrez and a team of legal experts.

The final version of the draft legislation, accessible on this website in Spanish as well as in English (an unofficial translation kindly provided by Professor José Antonio Moreno Rodríguez), reproduces the Draft Hague Principles albeit with adjustments necessary to bring it into line with the Inter-American Convention of 17 March 1994 on the Law Applicable to International Contracts.

The draft legislation is currently before the Senators of the Paraguayan Congress.
