“EU’s Ratification of the Choice of Court Convention”

The Law Society of England and Wales organised an event to celebrate the European Union (EU)’s ratification of the Convention of 30 June 2005 on Choice of Court Agreements (Convention). On this occasion, the importance of the Convention, including its possible impact on parties’ approach to forum selection was discussed. The relationship between the Convention and the parallel EU instrument, namely the Brussels I Regulation (recast) was also addressed. Participants highlighted that the increasing growth of the Convention’s geographical reach will result in greater legal certainty with respect to choice of court agreements and the recognition and enforcement of resulting judgments.

The Law Society has produced a briefing note on the Convention highlighting its importance and encouraging its wider ratification.
