Second meeting of the Working Group on the Study relating to Institutions Analogous to Trusts

From 6 to 7 October 2025, the second meeting of the Working Group (WG) on the study relating to institutions analogous to trusts was held online, hosted by the Permanent Bureau (PB). The meeting had more than 25 registered delegates and other experts, representing eight HCCH Members and five Observers, in addition to members of the PB of the HCCH.
Pursuant to its mandate (C&Ds No 70-72 of CGAP 2025), the WG reviewed the most recent draft of the Note on the Application and Interpretation of Article 2 of the Convention of 1 July 1985 on the Law Applicable to Trusts and on their Recognition and on the Institutions Analogous to Trusts, with a view towards its finalisation for circulation to Members of the HCCH for comment and eventual approval. The Note is intended to serve as reference material for legal practitioners dealing with issues relating to the application and interpretation of the 1985 Trusts Convention, as well as institutions that may be analogous to trusts. The publication of the Note is aimed at increasing global awareness of the Convention and highlighting the potential for the Convention to ensure greater legal certainty in the recognition of trusts and institutions analogous to trusts.
