Deutschland - zuständige Behörde (Art. 44)

Zu Artikel 44 KSÜ (Zuständige Gerichte und Behörden)

aa) Zuständige Behörde nach Artikel 33 KSÜ:

Zuständig für die Erteilung der Zustimmung zu einer Unterbringung eines Kindes nach Artikel 33 des Haager Kinderschutzübereinkommens vom 19. Oktober 1996 im Inland ist der überörtliche Träger der öffentlichen Jugendhilfe (Landesjugendamt), in dessen Bereich das Kind nach dem Vorschlag der ersuchenden Stelle untergebracht werden soll, andernfalls der überörtliche Träger, zu dessen Bereich die Zentrale Behörde den engsten Bezug festgestellt hat. Hilfsweise ist das Land Berlin zuständig.

bb) Behörden, an die die Ersuchen nach den Artikeln 8 und 9 KSÜ zu richten sind:

In gerichtlichen Verfahren betreffend die elterliche Verantwortung sind folgende Familiengerichte örtlich zuständig:

(a) Während der Anhängigkeit einer Ehesache ist unter den deutschen Gerichten das Familiengericht ausschließlich zuständig, bei dem die Ehesache im ersten Rechtszug anhängig ist oder war, sofern das Verfahren gemeinschaftliche Kinder der Ehegatten betrifft.

(b) Ansonsten ist das Familiengericht zuständig, in dessen Bezirk das Kind seinen gewöhnlichen Aufenthalt hat.

(c) Ist eine Zuständigkeit nach den Buchstaben (a) oder (b) nicht gegeben, ist das Familiengericht zuständig, in dessen Bezirk das Bedürfnis der Fürsorge bekannt wird.

In Fällen, die das Umgangsrecht, die elterliche Sorge oder die Kindesherausgabe betreffen, kann das Ersuchen auch an das Familiengericht am Sitz des Oberlandesgerichts gerichtet werden, in dessen Oberlandesgerichtsbezirk sich das Kind gewöhnlich aufhält, wenn ein Elternteil seinen gewöhnlichen Aufenthalt in einem anderen Mitgliedstaat der Europäischen Union oder in einem anderen Vertragsstaat des Haager Kinderschutzübereinkommen hat („Familiengericht mit konzentrierter Zuständigkeit“). Die Familiengerichte mit konzentrierter Zuständigkeit sind auf internationale Kindschaftssachen spezialisiert.

Ist oder wird bei einem deutschen Familiengericht mit konzentrierter Zuständigkeit ein Antrag auf Anerkennung oder Vollstreckbarerklärung einer Entscheidung nach dem Übereinkommen, der Verordnung (EG) Nr. 2201/2003 oder dem Europäischen Übereinkommen vom 20. Mai 1980 über die Anerkennung und Vollstreckung von Entscheidungen über das Sorgerecht für Kinder und die Wiederherstellung des Sorgeverhältnisses oder ein Antrag nach dem Haager Übereinkommen vom 25. Oktober 1980 über zivilrechtliche Aspekte internationaler Kindesentführung anhängig, so ist dieses Familiengericht für alle dasselbe Kind betreffenden Verfahren über das Umgangsrecht, die elterliche Sorge oder die Kindesherausgabe zuständig.

Familiengerichte mit konzentrierter Zuständigkeit sind
a) für den Bezirk des Kammergerichts Berlin: das Amtsgericht Pankow/Weißensee;
b) für die Bezirke der Oberlandesgerichte in Niedersachsen: das Amtsgericht Celle;
c) im Übrigen: jeweils das Amtsgericht, in dessen Bezirk ein Oberlandesgericht seinen Sitz hat.

Die Zentrale Behörde kann bei der Ermittlung des zuständigen Gerichts behilflich sein oder  Ersuchen an das zuständige Gericht weiterleiten.
